Any order placed by a legal entity or a professional, in particular as part of a corporate offer, is subject to special conditions. Any order, booking, purchase or membership of a Service implies unreserved acceptance of these GTS and of the Club's house rules (hereinafter the “House Rules”, in Annex 1).

For orders placed online, acceptance is evidenced by ticking a box confirming that the Client has read and accepts the GTS, before the order is confirmed (button “Order with obligation to pay”, or any similar unambiguous wording, within the meaning of Article L.221-14 of the French Consumer Code). These GTS can be viewed on the website https://www.burningbar.fr and are available via the App. A copy of the GTS in force is given or made available to the Client on a durable medium before any order is concluded, in accordance with Article L.221-5 of the French Consumer Code.

The Client has a right of withdrawal under the conditions of article 5; the model form is set out in Appendix 2.

Article 1 — DEFINITIONS

1.1 For the purposes of these GTCS, the following terms are defined as follows:

BURNING FAM MEMBERSHIP — means the annual club membership contract, at the price of €50 incl. VAT, automatically renewed each year unless not renewed. It is separate from the Packs and monthly Subscriptions.

Monthly Subscription — means BURNING CLUB, BURNING UNLIMITED, THE RITUAL or THE ROUTINE, taken out in addition to an active BURNING FAM MEMBERSHIP, with a three-month initial commitment then automatic monthly continuation. In the common articles, the term “Subscription” includes the annual Membership and the monthly Subscriptions where the context so indicates.

App — means the Burning Bar mobile application, downloadable on iOS and Android platforms, allowing Sessions to be booked and giving access to the Club's services.

Black Door — means a specific Subscription, on request and at the sole discretion of the Club, valid only at the Paris 16 Studio (special conditions).

Burning Bar — means BURNING BAR, a simplified joint-stock company with a share capital of €1,000, whose registered office is located at 42 avenue Raymond Poincaré, 75016 Paris, registered with the Paris Trade and Companies Register under number 980 752 562, represented by its Chair, Ms Charlotte Guez.

Gift card — means credit for one or more Sessions offered to a beneficiary named at the time of purchase, usable under the conditions of article 4.3.

Client — means any natural person purchasing a Service within the meaning of these GTS. Club — means Burning Bar and the premises and spaces in which its Services are provided, as well as its digital tools (Site, App, booking and payment platforms).

Contract — means the contractual relationship between the Club and the Client, whether a Member or a one-off customer.

Membership anniversary date — means the annual renewal date of BURNING FAM MEMBERSHIP, calculated from its effective date. It does not change when a monthly Subscription is added. Start date — means the effective date of the contract concerned, communicated to the Client before payment and confirmed on a durable medium. The annual Membership and a monthly Subscription may start on different dates.

Monthly Period — means the period from the effective date of the monthly Subscription, then each corresponding monthly date, up to and including the day before the next date. Example: from 12 March to 11 April inclusive. Where the original day does not exist in a month, the due date is the last day of that month; subsequent due dates revert to the original day as soon as it exists. The exact dates are shown in the payment schedule provided to the Client. Serious Misconduct — means any inappropriate or serious behaviour or behaviour contrary to the Club's core values, including in particular: fraud (fraudulent use of the access card, card sharing, falsification of a subscription file), deliberate damage to facilities, failure to comply with safety or hygiene rules, violent or threatening behaviour towards other Members or staff, presence in a prohibited area, or any other behaviour likely to undermine the peace or safety of Members.

Membership fee — means the price of the annual BURNING FAM MEMBERSHIP, i.e. €50 incl. VAT per year and per Client. No second membership fee is charged for adding a Pack or a monthly Subscription.

Member / BB Member — means a Client whose BURNING FAM MEMBERSHIP is active. Merely purchasing a single Session or an introductory offer does not confer Member status.

BLACK DOOR Member — means a Client who has subscribed to the Black Door Membership, benefiting from specific access according to the specific conditions defined upon acceptance.

No-show — means the Client's absence from a booked Session, as well as refusal of access resulting from lateness of more than five (5) minutes within the meaning of Article 3.2 of the House Rules, resulting in deduction of the credit for an offer with a defined number of Sessions; no additional fee applies to BURNING UNLIMITED.

Pack — means prepaid Session credit usable under the validity, non-transferability and non-refund conditions set out in articles 4.2 and 7.

Parties — means the Club and the Client together.

Commitment Period — means the period defined in article 8.1.

Services — means single Sessions, Session Packs, Gift cards for Sessions, and Memberships. The Services do not include the sale of Products, which is governed by the Merchandising GTCS.

Products — means merchandise, clothing, accessories, drinks and food products offered for sale by the Club, online or in a Studio, governed by the Products / Merchandising General Terms of Sale (the “Merchandising GTS”).

Semi-private Reformer — means a coached Session on Reformer machines, only at the Paris 16 Studio, in a semi-private format, i.e. a maximum of three (3) people, lasting fifty (50) minutes.

Session — means a group session of Hot Pilates, Barre, Sculpt, Meditation or any other discipline added to the schedule, as well as any semi-private Reformer session, lasting fifty (50) minutes unless otherwise stated.

Private Session — means a coached Session in a 1:1 format or any other format defined by the Club, by reservation, on specific terms and rates.

Site — means the Club's website at https://www.burningbar.fr. Studio — means the two (2) studios owned and operated by the Club, located respectively at: Paris 16 Studio, 42 avenue Raymond Poincaré, 75016 Paris (basement); Paris 7 Studio, 9 avenue Frédéric Le Play, 75007 Paris (basement).

1.2 The terms defined in article 1.1 have the same meaning whether used in the singular or plural in these GTCS.

Article 2 — CONTRACTUAL DOCUMENTS APPLICABLE TO THE RELATIONSHIP BETWEEN THE CLUB AND THE CLIENT

2.1 The Contract between the Club and the Client comprises:

these GTCS;

the House Rules (Appendix 1); and

where applicable, any specific conditions relating to a Membership.

For purchases of Products, the Merchandising GTCS apply in addition to or instead of these GTCS, according to their respective scope.

2.2 The Contract is personal, in the Client’s name and non-assignable.

2.3 The Club reserves the right to refuse to provide any Service to the Client in the event of non-compliance with these GTS or the House Rules, or for any other legitimate reason. Such refusal may in no case be based on a discriminatory ground within the meaning of Articles 225-1 and 225-2 of the French Criminal Code.

Article 3 — ANNUAL MEMBERSHIP AND MONTHLY SUBSCRIPTIONS

3.1 Joining BURNING FAM MEMBERSHIP

Introductory offers and single Sessions defined in Article 4 are accessible without Membership. Purchasing a member Pack or taking out a monthly Subscription requires an active BURNING FAM MEMBERSHIP.

To apply for Membership, the Client must have taken at least three classes booked directly with Burning Bar and be sponsored by an existing Member. They then send their application to the Club. The team reviews the application and communicates its decision; the €50 payment is made after acceptance. Neither three unattended bookings nor payment alone amount to acceptance of Membership.

For admission and for the minimum attendance, Hot Room and Reformer classes actually attended and booked via the Site, the App or directly with the team are counted, including classes under introductory offers. Bookings made through partner platforms and Sessions not honoured are not counted.

The Club may refuse a Service or a Membership only for a legitimate and non-discriminatory reason, in accordance with the applicable rules. The admission procedure does not allow these rules to be set aside.

3.2 Price, duration and renewal of the annual Membership

BURNING FAM MEMBERSHIP costs €50 incl. VAT for twelve months from its effective date. This amount is the entire price of Membership: no classes are included. Packs and monthly Subscriptions are paid separately.

Membership renews automatically each year, unless non-renewal is requested under Article 8. The Club provides the prior information required by Article 8.2; a simple reminder of a direct debit fifteen days before the due date does not replace this information.

The €50 is charged only once per membership year and per Client, even if several monthly Subscriptions are taken out. Adding or ending a monthly Subscription does not change the membership anniversary date.

In the event of non-renewal requested by the Client, Membership remains usable until its annual expiry; no refund of the current annual period is due on that basis alone. Withdrawal rights and legitimate reasons remain applicable. In the event of termination for a legitimate reason or at the Club's initiative in the absence of any breach by the Client, sums corresponding to the unexpired annual membership period are refunded pro rata. In the event of withdrawal, the refund is calculated in accordance with Article 5.

3.3 BURNING FAM MEMBERSHIP benefits and attendance

Active Membership allows you to:

purchase member Hot Room Packs, usable in both Studios, and member Reformer Packs, usable at Paris 16;

book, at weekends, the gym, sauna and hammam at Paris 16;

book, at weekends, the gym at Paris 7;

take out a monthly Subscription in addition.

This access is subject to booking, opening hours and available capacity. No access to a swimming pool is included; the Club has no swimming pool in its Studios. Access to the sauna and hammam at the Paris 7 Studio is suspended until further notice.

To keep their benefits, the Member must attend at least two classes per month. This minimum does not apply during an active BURNING CLUB or BURNING UNLIMITED Subscription. In the event of insufficient attendance, the Club sends a reminder and speaks with the Member about their situation. No automatic suspension of benefits, cancellation of credits already paid for or additional charge is applied on that basis alone.

The minimum attendance is counted per calendar month, from the first to the last day of the month. The first, incomplete month of Membership is exempt. This calendar is separate from the monthly billing Periods of the Subscriptions. Eligible classes and booking channels are those of Article 3.1; only classes actually attended are counted.

3.4 Optional monthly Subscriptions

The following prices are in addition to the annual Membership of €50 incl. VAT, charged only once under Article 3.2.

BURNING CLUB — €111 incl. VAT per Monthly Period: at Paris 16, access to the gym, sauna and hammam, seven days a week, by booking. No class credit is included. No minimum number of classes is required during the active Subscription.

BURNING UNLIMITED — €590 incl. VAT per Monthly Period: Hot Room classes in both Studios; semi-private Reformer at the Paris 16 Studio; gym, sauna and hammam at the Paris 16 Studio, seven days a week. All access is subject to booking and available places. No minimum number of classes is required during the active Subscription.

THE RITUAL — €220 incl. VAT per Monthly Period: four Reformer Sessions. THE ROUTINE — €420 incl. VAT per Monthly Period: eight Reformer Sessions. The rules on use and expiry are set out in Article 4.4.

All four offers carry an initial commitment of three months, i.e. three monthly payments, then continue automatically month to month until terminated. The exceptions in Article 8 remain applicable.

Holders of BURNING CLUB, BURNING UNLIMITED, THE RITUAL and THE ROUTINE keep all the benefits of their active BURNING FAM MEMBERSHIP, notably the gym at the Paris 7 Studio at weekends, by booking. The monthly Subscription adds its own services without removing the basic benefits.

3.5 Billing, periods and combining offers

Monthly Subscriptions are paid on their effective date and then at the start of each Monthly Period, according to the payment schedule given to the Client. The Reformer credit calendar and the termination date follow these same Monthly Periods, not calendar months.

Example: effective date 12 March; first Period from 12 March to 11 April inclusive; subsequent payments on 12 April and 12 May. The three-month commitment ends on 11 June inclusive. The Subscription then continues automatically, unless a termination request taking effect on that date is made.

The end of a monthly Subscription does not, by itself, amount to non-renewal of BURNING FAM MEMBERSHIP. A request to stop all offers must give rise to a separate confirmation of the end date of each contract. If the Client requests non-renewal of BURNING FAM MEMBERSHIP while one or more monthly Subscriptions are still active, that request also provides for those Subscriptions to stop at the annual due date. For each of them, the effective end is the later of the end of the Monthly Period containing that annual due date and the end of its three-month initial commitment. The Client may separately request an earlier monthly end, under Article 8.3. Early notification of annual non-renewal therefore does not cause the monthly Subscriptions to stop immediately. No new annual debit of €50 is made. As a linking measure, BURNING FAM MEMBERSHIP benefits are maintained without additional annual fees until the last effective end date of the monthly Subscriptions concerned. Monthly payments due up to that date remain payable. The Club confirms all dates in writing.

3.6 Specific BLACK DOOR offer and non-transfer

BLACK DOOR is an on-request offer, at the Paris 16 Studio only. Admission conditions, price, duration, renewal and access are communicated in writing before subscription. The special conditions state expressly whether the annual BURNING FAM MEMBERSHIP applies. No guest pass is offered. Contracts and Session credits are personal and non-transferable, subject to the rules specific to Gift cards.

Article 4 — SERVICES AND PRICES

Unless otherwise specified, the validity of limited-duration offers runs from the date of purchase. Sessions must be taken before or on the expiry date shown in the confirmation; a booking for a later date does not extend validity. Credits under monthly Subscriptions follow exclusively the Monthly Period of the contract.

4.1 Hot Room Sessions (à la carte)

1 HOT ROOM SESSION — one (1) Session: forty euros (€40). Valid for twelve (12) months from purchase.

Welcome Pack (three (3) Sessions): sixty euros (€60). Valid for one (1) month. Reserved for new Clients. Only one purchase per Client.

4.2 “For Members Only” Hot Room Packs

The Packs below are reserved for BB Members holding an active BURNING FAM MEMBERSHIP on the day of purchase.

BB DISCOVERY HOT ROOM · 5 sessions: five (5) Sessions — one hundred and ninety euros (€190) — valid for one (1) month.

BB SILVER HOT ROOM · 8 sessions: eight (8) Sessions — two hundred and eighty-eight euros (€288) — valid for three (3) months.

BB GOLD HOT ROOM · 12 sessions: twelve (12) Sessions — three hundred and eighty-four euros (€384) — valid for six (6) months.

BB PLATINUM HOT ROOM · 20 sessions: twenty (20) Sessions — six hundred euros (€600) — valid for twelve (12) months.

BB DIAMONDS HOT ROOM · 50 sessions: fifty (50) Sessions — one thousand three hundred and seventy-five euros (€1,375) — valid for twelve (12) months.

The validity period runs from the date the Pack is purchased. All Sessions must be taken no later than the expiry date notified to the Client; booking before that date a class that takes place after expiry does not extend validity. The Pack does not renew automatically.

Credits from a Pack purchased during an active Membership remain usable until their expiry date even if Membership is not renewed. The end of Membership does not delete credits already paid for. An active Membership remains necessary to purchase a new member Pack. This rule applies to Hot Room and Reformer Packs.

4.3 Gift cards (Hot Room)

One (1) Session: forty euros (€40). Valid for twelve (12) months from the date of purchase.

Two (2) Sessions: eighty euros (€80). Valid for twelve (12) months from the date of purchase.

The Gift card is assigned to the beneficiary named at the time of purchase. After its first use, it is not transferable. Before its first use, transfer to another beneficiary is possible; the buyer informs the Club of the identity of the new beneficiary so that the Card can be updated. No BURNING FAM MEMBERSHIP status should be presumed necessary to use a Hot Room Gift card.

Gift cards are neither refundable, exchangeable nor extendable, except where required by law — in particular the exercise of the right of withdrawal provided for in Article 5 where the gift card was purchased at a distance — or by exceptional written decision of the Club.

4.4 Semi-private Reformer Sessions (Paris 16 Studio only)

The semi-private Reformer is offered only at the Paris 16 Studio, in two formats: PURE REFORMER SESSION and HOT & GLOW REFORMER SESSION. Purchasing BB REFORMER · 5 SESSIONS and BB REFORMER · 12 SESSIONS Packs requires an active BURNING FAM MEMBERSHIP on the day of purchase. The treatment of the end of Membership is set out in Article 3.5.

THE RITUAL credits four Sessions and THE ROUTINE eight Sessions at the start of each Monthly Period defined in Article 1.1. These Sessions must be taken during that Period; unused credits expire at its end, with no carry-over or refund on the sole ground of non-use, subject to the exceptions in Articles 5, 8 and 14. Four Sessions per Monthly Period do not amount to a guarantee of one Session every week.

BB REFORMER · 5 SESSIONS and BB REFORMER · 12 SESSIONS Packs are paid for once, do not renew automatically and take effect on the date of purchase, for two and six months respectively. All Sessions must be taken before expiry.

FIRST BURN is reserved for the first Reformer Session taken at Burning Bar, even if the Client has already taken part in the Hot Room. Only one purchase is allowed per person. The Session must be taken within one month of purchase.

Burning Unlimited: access to Reformer experiences, the Hot Room and the club spaces included in the Subscription, under the conditions of Article 3.4 — five hundred and ninety euros (€590) per month, plus, where applicable, the annual Membership fee (Article 3.2).

THE 111 EXPERIENCE: one (1) Private Session — one hundred and eleven euros (€111) — private hire of the Reformer room for a private class. Contact the Club to book.

THE RITUAL and THE ROUTINE monthly offers are subject to articles 3.5 and 8 (commitment, termination) like the other Memberships.

Reformer-specific conditions:

Cancellation up to twelve (12) hours before the start of the Session: the credit is kept. After that time, it is deducted for offers with a defined number of Sessions. BURNING UNLIMITED incurs no additional fee.

Lateness of more than five (5) minutes: access refused; the credit is deducted for offers with a defined number of Sessions. No additional fee for BURNING UNLIMITED.

Non-slip socks and a machine towel are mandatory.

HOT & GLOW: THE RED RESET (a few minutes under red LED light at the end of the session) is optional; the protective glasses provided are mandatory during exposure to the LED light.

Any injury, pregnancy or relevant medical condition must be reported before the Session. In the event of pregnancy, the Club refers the Client to PURE REFORMER SESSION, after medical advice.

Non-transferable, non-refundable, cannot be extended, subject to articles 5, 8.4 and 14.2.

Transitional provision: Reformer packs and subscriptions taken out before 1 November 2026 remain valid, under their original terms, until their expiry date.

4.5 Prices and price changes

All prices are stated in euros, including all taxes (VAT included).

The prices applicable to a one-off order are those in force on the day of the order. The Club may change the prices of its Subscriptions, provided it informs the Member in writing at least two (2) months before the change takes effect. A Member who refuses the new pricing may terminate their Subscription without charge or penalty, by any means provided for in Article 8.3, until the date the change takes effect; sums already paid for the unexpired period are refunded pro rata. Failing termination within that period, the new pricing is deemed accepted.

Article 5 — RIGHT OF WITHDRAWAL

5.1 In accordance with articles L.221-18 et seq. of the French Consumer Code, a consumer Client who concludes a Contract remotely (Website or App) or off-premises has fourteen (14) calendar days to exercise their right of withdrawal, without having to give reasons or bear any costs other than those provided for in article 5.4. The period runs from the day after the Contract is concluded.

5.2 In accordance with article L.221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for:

Sessions and Private sessions booked for a specific date and time, which constitute leisure services provided on a specific date or during a specific period;

Services fully performed before the end of the withdrawal period, whose performance began at the Client’s express prior request and for which the Client expressly waived their right of withdrawal.

Memberships, Packs and Gift cards purchased remotely, which do not relate to a specific date, give rise to a right of withdrawal under the conditions of this article.

5.3 To exercise the right of withdrawal, the Client notifies the Club of their decision before the end of the period, using the form in Annex 2 or any other unambiguous statement, sent to:

by email to contact@burningbar.fr; or

by post to BURNING BAR — 42 avenue Raymond Poincaré, 75016 Paris.

The Club sends the Client an acknowledgement of receipt of the request without delay. This express request is collected at the time of the order.

5.5 The Club refunds the Client all sums paid, less where applicable the amount due under Article 5.4, no later than fourteen (14) days from the day on which it is informed of the decision to withdraw, using the same means of payment as that used for the initial transaction, unless the Client expressly agrees to another means.

Article 6 — PAYMENT AND PAYMENT DEFAULT

6.1 Payments are made through the Club's tools (Site, App, Mindbody or equivalent tool).

6.2 The recurring payment method offered, its amount and its frequency are presented to the Client before subscription. Where a SEPA direct debit is used, a mandate is collected. The following provisions concern SEPA direct debits and do not describe the rules specific to recurring payment by bank card. In accordance with the applicable regulations (Directive (EU) 2015/2366 — PSD2; Articles L.133-25 et seq. of the French Monetary and Financial Code), the Client has a right to dispute any authorised debit within eight (8) weeks of the debit date, and any unauthorised debit within thirteen (13) months. The Client may revoke their direct debit mandate at any time with their bank. Revoking the mandate does not, by itself, terminate the contract and does not erase sums properly due. The terms of recurring payment by bank card must be presented separately if this method is used.

6.3 In the event of a rejected direct debit, non-payment, fraud or manifestly unfounded dispute, the Club sends the Client a formal notice to regularise their situation within eight (8) days. Failing regularisation within that period, the Club may:

suspend access to the Services; and/or

cancel current bookings; and/or

terminate the Membership under the conditions of article 8.6; and/or

take any action to recover the sums due.

The Client’s good-faith exercise of the right to dispute provided for in article 6.2 cannot give rise to any of these measures.

Article 7 — NO TRANSFER, NO REFUND, NO EXTENSION

7.1 Except where required by law — in particular the right of withdrawal provided for in Article 5, termination for a legitimate reason provided for in Article 8.4 and force majeure provided for in Article 14 — or by exceptional written decision of the Club:

Packs, Session credits and Memberships are personal and non-transferable; Gift cards are issued in the name of the beneficiary designated at the time of purchase, under the conditions of article 4.3;

Sessions not used by the end of their validity period are lost;

no refund is due if the Client does not use their Session credits;

no extension of validity is granted, subject to article 14.2.

7.2 The Club informs the Client of the upcoming expiry of their Session credits at least fifteen (15) days before the end of their validity period, by notification via the App or by email.

Article 8 — NON-RENEWAL AND TERMINATION

8.1 Three-month commitment for monthly Subscriptions

BURNING CLUB, BURNING UNLIMITED, THE RITUAL and THE ROUTINE carry an initial commitment of three Monthly Periods from their effective date. The Client owes three monthly payments, whether or not they use the Services, subject to the right of withdrawal and the exceptions provided for in these GTS.

The Client may submit their termination request during the commitment. Except in the cases of exceptions, actual termination takes effect at the earliest at the end of the third Monthly Period. They are not required to wait until the end of the commitment to send their request.

8.2 Prior information on renewal

For BURNING FAM MEMBERSHIP, an annual contract with tacit renewal, the Club sends the Client a personal letter or a dedicated email within the period provided for by Article L.215-1 of the French Consumer Code, between three months and one month before the end of the period allowing renewal to be rejected. This notice clearly states the non-renewal deadline.

Failing compliant information, the Client may terminate the contract free of charge from its renewal, under the conditions of this Article; advance payments corresponding to the period after the end of the contract are refunded within the legal time limit, at the latest thirty days after termination. The Client's other statutory rights remain applicable.

Monthly Subscriptions continue for an indefinite period after the initial commitment; they do not recreate a three-month commitment with each debit. The payment schedule, the initial term and the terms for stopping are given to the Client on a durable medium.

8.3 Requesting termination and knowing the end date

Monthly Subscription: the request may be sent at any time, with no additional notice period. Except in the cases of exceptions, it takes effect on the later of the end of the initial commitment and the end of the Monthly Period in progress when the request is received. Periods due up to that date remain payable; no further monthly debit is made beyond it.

Example: subscription on 12 March, commitment until 11 June inclusive. A request received on 20 April takes effect on 11 June. A request received on 20 June takes effect on 11 July. Termination is therefore not calculated at the last day of the calendar month.

Annual BURNING FAM MEMBERSHIP: the non-renewal request may be sent before the annual due date; it takes effect on that date, with no new annual debit. Access remains open until that date, subject to the other contractual conditions.

The request may be made:

via the online termination request page, available at burningbar.fr/demande-de-resiliation (it opens a pre-filled email addressed to contact@burningbar.fr; the Club confirms the end date in writing);

by email to contact@burningbar.fr;

by post to BURNING BAR, 42 avenue Raymond Poincaré, 75016 Paris. Registered post may be used but is not mandatory.

The Client states their name, contact details allowing their account to be identified and the contract(s) concerned. The Club confirms receipt of the request and the end date of each contract on a durable medium, within a reasonable time; for requests by email, it undertakes to acknowledge receipt within forty-eight hours. A delay in acknowledging receipt does not postpone the date on which the request was received.

The electronic functionality provided for in Article L.215-1-1 must be accessible for contracts taken out online and for other contracts where the Club offers online subscription on the day of termination.

Stopping a monthly Subscription does not automatically end BURNING FAM MEMBERSHIP. Non-renewal of BURNING FAM MEMBERSHIP ends the monthly Subscriptions at the annual due date under the linking rule of Article 3.5: end at the close of the Monthly Period containing that date, at the earliest at the end of the initial commitment; no new annual payment; temporary retention of benefits until the last effective end date. Monthly payments properly due up to that date remain payable.

8.4 Legitimate reasons for early termination

The Client may terminate their Membership before the end of the Commitment Period, without penalty, if one of the following legitimate reasons occurs:

moving house, making it impossible to use the Services;

long-term illness, injury or physical incapacity preventing practice, duly supported by a medical certificate;

pregnancy with medical advice contraindicating sports practice;

loss of employment or job transfer at the employer’s initiative;

death of the Client.

Any legitimate reason invoked must be supported by a relevant document that is strictly necessary to examine the request, without requiring details of a medical diagnosis. This document is sent to the Club in the manner set out in Article 8.3. Termination takes effect on the date the supporting document is received. Sums already paid for the unexpired period and unused, unexpired Session credits are refunded to the Client pro rata.

8.5 No suspension or freeze

The Club does not offer suspension or freezing of the Subscription, subject to Article 14.2.

8.6 Termination by the Club

The Club may terminate the Contract after formal notice sent to the Client by email or by post and left unanswered for eight (8) days, in the event of:

fraud;

non-compliance with the House Rules or these GTCS;

inappropriate behaviour;

non-payment;

presence in a prohibited area;

endangering oneself or others.

In the event of Serious misconduct making it impossible to continue the Contract, termination is immediate and without prior formal notice.

In the event of termination at the Club's initiative, Session credits already paid for, unused and not expired are refunded to the Client, without prejudice to the Club's right to claim compensation for the loss it has suffered.

Article 9 — SALE OF PRODUCTS / MERCHANDISING

9.1 The sale of Products, online via the shop accessible from the Website or in person in the Studios, is governed by the Merchandising GTCS, available on the Website and in the Studio.

9.2 The Merchandising GTCS govern in particular the ordering, payment, delivery, withdrawal, legal guarantee and liability conditions applicable to the purchase of Products. The Client is invited to read them before purchasing any Product.

9.3 These GTCS remain applicable to the Services (Sessions, Memberships, Session Packs, Gift cards). In the case of a mixed order covering both Services and Products, these GTCS apply to the Services and the Merchandising GTCS apply to the Products. Data used for commercial prospecting purposes is kept for three (3) years from the Client’s last active contact. Payment data, excluding card numbers, is kept in accordance with legal accounting and tax obligations. Card numbers are kept exclusively by the certified payment service provider.

11.3 Cameras are installed at reception and in the corridors of both Studios; no sound is recorded.

The system serves the purpose of the safety of persons and protection against theft and damage. They are viewed only in the event of a reported incident — bodily injury, fainting, theft or damage — and only by persons authorised by the Club. Recordings are kept for thirty (30) days at most, then automatically deleted, except where needed for an incident being handled or for legal proceedings.

11.4 Data relating to the Client's health (medical certificate of fitness, declaration on honour, contraindications, pregnancy) constitutes sensitive data within the meaning of Article 9 of the GDPR. It is processed on the basis of the Client's explicit consent (Article 9.2.a of the GDPR), solely for the purpose of safe sports practice, and is accessible only to authorised persons at the Club. It is kept for the duration of the contractual relationship and deleted no later than twelve (12) months after its end. Explicit consent, where it is the basis relied on, is collected separately from the GTS and may be withdrawn at any time. Acceptance of the GTS alone does not amount to consent to the processing of health data. A refusal or withdrawal of consent does not automatically result in refusal of access; any separate safety condition must be justified, necessary and proportionate. Health data is not used for commercial purposes. The legal basis, the recipients and the actual retention period of each supporting document must be documented before the processing is implemented.

11.5 The Client’s personal data may be transmitted to the following categories of recipients: technical service providers necessary for the performance of the Contract (hosting, online payment, booking platform — in particular Mindbody Inc.), communication service providers (emailing) and, where applicable, competent authorities where required by law. Where data is transferred outside the European Economic Area, such transfers are subject to appropriate safeguards within the meaning of Chapter V of the GDPR (standard contractual clauses adopted by the European Commission or, where applicable, an adequacy decision of the European Commission). The Client may obtain a copy of these safeguards by writing to contact@burningbar.fr.

11.6 The Club keeps a list of persons excluded for Serious Misconduct, solely for the purpose of the safety of persons and property, on the basis of its legitimate interest (Article 6.1.f of the GDPR). This list is kept for three (3) years from the exclusion decision. The person concerned is informed of it and has the rights provided for in Article 11.7.

11.7 In accordance with the GDPR and Law No. 78-17 of 6 January 1978 as amended, the Client has the following rights: right of access (Article 15 of the GDPR), right to rectification (Article 16), right to erasure (Article 17), right to restriction of processing (Article 18), right to data portability (Article 20), right to object (Article 21), right to withdraw consent at any time, and right to give instructions regarding the fate of their data after death. These rights are exercised by email at contact@burningbar.fr or by post to the Club's registered office. The Club undertakes to reply within one (1) month of receiving the request. The Client may lodge a complaint with the French data protection authority (CNIL — www.cnil.fr).

Article 12 — INTELLECTUAL PROPERTY

12.1 All elements of the Site, the App and the Club's communication materials (the BURNING BAR and BLACK DOOR brands and any other trademark, registered or not, logos, trade names, editorial content, photographs, videos, playlists, graphics, brand guidelines, teaching methods) are protected by intellectual property law and remain the exclusive property of the Club or its rights holders.

12.2 Any reproduction, representation, modification, adaptation or exploitation, in whole or in part, of these elements, by any means whatsoever, without the prior written consent of the Club, is prohibited and constitutes infringement punishable under Articles L.335-2 et seq. and L.713-2 et seq. of the French Intellectual Property Code.

12.3 Access to the Services and the App confers on the Client only a personal, non-exclusive and non-transferable right of use. An insurance certificate is displayed in each Studio and may be provided to the Client on simple request.

13.2 The Client is invited to take out a personal civil liability insurance policy, intended to cover damage they may cause to third parties, through their own act, while taking part in the Club's activities.

13.3 The Club informs the Client of the benefit of taking out personal accident insurance covering bodily injury to which sports activity may expose them, in accordance with the obligations applicable to operators of physical and sports activity facilities.

Article 14 — FORCE MAJEURE

14.1 Neither Party may be held liable for the non-performance or delay in performance of any of its obligations under the Contract where such non-performance or delay results from a force majeure event within the meaning of article 1218 of the French Civil Code, in particular: natural disaster, epidemic or pandemic, administrative decision to close or restrict access, general strike, fire, water damage, or failure of essential equipment that cannot be replaced within a reasonable time. The Client’s personal situations do not fall under this article; they are dealt with in article 8.4.

14.2 In the event of force majeure, the affected obligations are suspended for the duration of the event. The validity period of Packs and Session credits is extended by a period equivalent to the suspension, by way of exception to article 7.1. It is also prohibited to use, consume or store flammable products. The financial consequences of lateness, no-shows and cancellations are governed by the GTS and by these Rules.

1. Admission conditions and authorised public

1.1 Minors. The purchase of Services and access to the Club are prohibited for minors under sixteen (16). A minor aged sixteen (16) or over may become a Member of the Club provided they are accompanied, within the Club, by a legal guardian who supervises them. The Contract is signed by the minor and by their legal guardian, who undertakes to pay the price in their name and on behalf of the minor and must sign a parental authorisation, which must be handed in beforehand. This authorisation does not discharge the Club from its legal obligations or its liability in the event of fault. A medical certificate of fitness to practise the physical and sports activities offered by the Club is also mandatory for any minor Member. In the event of non-compliance with these conditions, the Club reserves the right to refuse the minor access to its premises.

1.2 Health, heat and exertion conditions. Certain Services take place in a heated environment (notably the Hot Room), in which the temperature is between thirty-three (33) and thirty-five (35) degrees Celsius depending on the Session.

The Hot Room is not allowed during pregnancy. After childbirth, Hot Room practice is possible once rehabilitation is complete and with medical approval.

The Club recommends obtaining prior medical advice, in particular in the event of a history of cardiorespiratory problems or fainting, as well as in the event of pregnancy, chronic illness or any other contraindication to heat and/or exertion. The Client is invited to provide, at registration, a medical certificate of fitness to practise the physical and sports activities offered by the Club. Failing that, the Client declares on their honour that their health and physical condition are compatible with the activities offered, notably Hot Pilates, and that they do not suffer from any illness, in particular cardiac or respiratory, injury or physical unfitness likely to prevent them from practising these activities.

The Client acknowledges:

that they must comply with safety instructions; this obligation does not exempt the Club from its legal liability;

that they must leave the room immediately in the event of feeling unwell, dizziness, pain, breathing difficulty or any other abnormal symptom, and inform a member of staff;

that the Club does not provide personalised medical supervision.

2. Access to the Club, Studios and capacity

2.1 Access by booking. Access to the Studios and classes is by booking only via the Site and/or the App. The Club may change the schedule, replace a coach or adapt classes for objective organisational, technical or safety reasons. It informs the Clients concerned. A change may not permanently remove an essential part of the contract without appropriate handling of the Client's situation.

2.2 Capacity and opening hours. Maximum capacity per room is limited; the number of places available is shown at the time of booking. If maximum capacity is reached, the Club may refuse access with no compensation other than handling of the Session credit according to the applicable rules (Article 3 of these Rules).

The Club is open Monday to Friday from seven a.m. (7:00) to ten thirty p.m. (10:30 pm), and on Saturday and Sunday from ten a.m. (10:00) to nine thirty p.m. (9:30 pm). Any change to opening days or hours is communicated to Members at least seven (7) days in advance, except in an emergency or in a case of force majeure.

2.3 Strictly prohibited areas. The Client may only move around in areas accessible to the public. Any presence in a prohibited area (other floors, technical areas, storerooms, private areas) constitutes Serious Misconduct: the Club may order immediate exclusion, terminate the Contract under the conditions of Article 8.6 of the GTS and refuse any future Service. Session credits already paid for, unused and not expired are refunded to the Client, without prejudice to the Club's right to claim compensation for the loss suffered.

3. Booking, cancellation, no-shows, changes

3.1 Cancellation by the Client. The Client may cancel free of charge up to twelve (12) hours before the start of the Session. After that time, the corresponding credit is deducted from the offer with a defined number of Sessions. For BURNING UNLIMITED and bookings of the gym, sauna and hammam, a late cancellation or an absence incurs no additional fee. The Client is expected to cancel as soon as they know they will not attend; the twelve-hour period allows places to be released for other Clients.

3.2 Late arrival. In the event of a delay of more than five (5) minutes, access to the Session is refused in order to preserve the safety and experience of the group. The Session is then due and constitutes a No-show.

3.3 No-show. For an offer with a defined number of Sessions, any No-show results in deduction of the corresponding credit. No additional penalty is applied. For BURNING UNLIMITED and bookings of the gym, sauna and hammam, no additional fee is charged, in accordance with Article 3.1 of these Rules.

3.4 Waitlist. The Club may offer a waitlist. A Client on the waitlist is notified of the allocation of a place via the App or by any other means and has a reasonable time to confirm or decline the allocated Session. After this time without a reply, the place is offered to the next Client on the list. Any Session expressly confirmed and not honoured follows the No-show regime of Article 3.3 of these Rules: deduction of the credit for an offer with a defined number of Sessions, with no additional fees for BURNING UNLIMITED.

3.5 Cancellation or change by the Club. If the Club cancels a class (coach unavailable, technical incident, safety), the Club re-credits the Session to the Client's account where the offer includes a defined number of Sessions. An unlimited offer does not give rise to any credit deduction as a result of this cancellation. The re-credit must actually be usable: if the original expiry date prevents this, the Club offers a suitable extension or a refund of the cancelled service. The Client's rights in the event of non-performance remain applicable.

3.6 Anti-abuse limits. The Club may set a number of simultaneous bookings to guarantee fair access. This limit and its scope must be communicated to the Client before subscription and be visible when booking. Any substantial change to a contract in progress follows Article 15 of the GTS. A booking is not guaranteed merely because an offer is unlimited.

4. Member card, access, fraud 4.1 A member card may be issued depending on the Subscription taken out.

The card is personal and non-transferable.

Loss or replacement: ten euros (€10).

Any fraud (scanning in for a third party, lending a card) results in suspension or termination of the Membership under the conditions of article 8.6 of the GTCS.

5. Changing rooms, lockers, personal belongings

5.1 Lockers are provided as a convenience. The Club does not provide individual safekeeping of belongings: the Client remains responsible for their personal effects.
